Beijing Yizhuang Takes the Lead in Formulating Negative Lists for Data Export in Medical Devices and Autonomous Driving

On May 11, the Beijing Cyberspace Administration, the Beijing Municipal Commerce Bureau, and the Beijing Municipal Administration of Government Services and Data jointly released the "Data Export Management List (Negative List) (2025 Edition) for the China (Beijing) Pilot Free Trade Zone and the National Comprehensive Demonstration Zone for Expanding Opening Up in the Service Industry," along with supporting management measures. This expands the data export negative list from the pilot free trade zone to the entire provincial administrative region.

Li Wenfeng, Deputy Director of the Management Committee of Beijing Economic-Technological Development Area, stated at the press conference that as the main hub for Beijing's high-end and precision industries, Beijing Yizhuang (the common name for the development area) has already established six industrial clusters each valued at over 100 billion yuan. To address the challenges enterprises face with data export, Beijing Yizhuang has introduced five concrete measures.

The first measure is leading the formulation of two new lists. Building on its participation in the city's first negative list, Beijing Yizhuang is now responsible for drafting negative lists specifically for the medical devices and autonomous driving sectors. These lists strictly align with industry laws, regulations, and national standards, detailing scenarios, categories, and data volumes item by item, providing frontline evidence for optimizing the municipal-level list.

The second is establishing a Data Cross-Border Service Station. This station has provided policy interpretations to nearly 200 enterprises and in-depth guidance to over 60 companies. It assisted Bayer in becoming the first enterprise in China to achieve full-scenario data compliance for core business exports and facilitated AstraZeneca in becoming the first case of compliant decentralized clinical trial data export in the country. These successes have significantly boosted foreign enterprises' confidence in investing in Yizhuang and promoted AstraZeneca's establishment of its "Global R&D Beijing Center" there.

The third measure involves end-to-end risk monitoring. A joint assessment mechanism has been established, implementing closed-loop management from pre-export review, in-process filing, to post-export evaluation. This not only accumulates practical experience for regulators but also helps enterprises build a solid defense line for compliant development.

The fourth is incentivizing corporate compliance. Special policies have been issued to provide financial support to enterprises within the zone that complete "first assessments, first filings, or first certifications" for data cross-border compliance, using tangible rewards to encourage proactive compliance.

The fifth is creating a data cross-border operation platform. Support has been given to establish the Beijing International Data Cross-Border Service Co., Ltd. Leveraging the country's first data fundamental system pilot zone and the city's largest public intelligent computing center, the area plans to build a cross-border trusted data space and set up a dedicated "E-Data Connect" channel.

Li Wenfeng stated that Beijing Yizhuang will expand the policy coverage from the Yizhuang cluster to the entire Yizhuang New City. Service windows will be set up in parks such as the International Medical Innovation Park and the Yizhuang Comprehensive Bonded Zone. Following the release of the medical devices and autonomous driving lists, enterprises will be supported to pilot the measures, ensuring rapid policy implementation and early benefits for companies.
