At the Gaoligong International Health Resort Town in Tengchong, Yunnan Province, a pattern of persistent unauthorized construction has transformed the residential landscape. Property owners have reportedly excavated hillsides, expanded homes, and converted residences into commercial lodgings, all while formal complaints to authorities have yielded limited results.

Visits to the site revealed numerous structures that deviate sharply from original plans. Some homeowners have connected multiple units, while others have added floors or carved into the mountain to create basements, with one property expanding from roughly 100 square meters to over 2,800 square meters. This area, initially planned as a residential community with 470 low-rise units, now hosts an estimated 58 guesthouses operating without proper commercial zoning approvals.

Local authorities acknowledge the scale of the issue, noting that nearly half of the homes in the area involve some form of unauthorized building. A staff member at the Tengchong Housing and Urban-Rural Development Bureau candidly described a cat-and-mouse dynamic, advising that construction could resume after inspectors leave, characterizing it as a game of wits between regulators and violators.

Despite a history of enforcement attempts—including 63 official violation notices, 40 disconnections of utilities, and fines exceeding 450,000 yuan for specific cases—many illegal constructions remain operational. A notable example includes a seven-story building constructed on a hillside, operating as a hotel, with penalties amounting to only about a week's worth of revenue during peak season.

Government responses have often labeled these violations as "historical issues" from before a 2023 joint task force was established. However, the task force leader admitted that only a few months are needed for the legal process to escalate from a notice to enforcement, a window some owners exploit. The slow legal pathway means that, as of the task force leader's tenure starting in January, no illegal structure had been fully demolished.

Experts are raising alarms over the safety and environmental implications. Professor Li Tianbin from Chengdu University of Technology warned that unapproved excavations and additions could lead to structural instability, especially given the region's seismic activity and heavy monsoon rains, which elevate landslide risks. Signs of ground subsidence and cracking were observed near some expanded properties, prompting calls for immediate structural assessments.

Adding to the concerns is the regulatory ambiguity around converting residential properties to commercial use. The Natural Resources Bureau confirmed no permits have been issued for such land-use changes, while the Market Supervision Bureau noted that business licenses for lodgings are granted on a commitment basis without on-site verification, potentially allowing unapproved operations to flourish.

Critics argue that fines are insufficient deterrence. Professor Xia Fangzhou from Renmin University emphasized that effective governance requires verifying compliance with original plans, ensuring safety risks are mitigated, and creating a transparent, enforceable loop from violation to rectification. He suggested public disclosure of planning permits, current measurements, penalty decisions, and remediation reports for each affected building, along with independent structural assessments.

As the community awaits a concrete resolution, the authorities acknowledge the ongoing struggle, with one official stating that solutions are "still being explored." The situation underscores a broader challenge of balancing property rights, safety, and regulatory enforcement in a scenic but geologically sensitive area.
